For Property Managers

Under ch. 215 § 215-44, compliant property operators generally ensure that all exterior areas are kept free of accumulated debris, scrap materials, and waste that could create hazards. Operators typically provide each dwelling unit with a sufficient number of durable, watertight, covered receptacles and ensure those containers are stored away from the front property line except during the permitted collection window. In multi-unit buildings, landlords commonly post notices and enforce policies that prevent tenants from leaving garbage in shared hallways or stairways, and they maintain those common areas accordingly.

For Tenants

Section 215-44 of the Jamestown Code of Ordinances gives tenants a basis to expect that their building's exterior and shared spaces will be kept free of hazardous accumulations and that adequate, properly maintained garbage receptacles will be provided. If a landlord fails to supply sufficient receptacles or allows garbage to accumulate in hallways or stairways, tenants may have grounds to raise that failure as a housing code violation. Tenants can generally report such conditions to the appropriate Jamestown code enforcement office or consult a local tenant-rights organization to understand what options may be available to them.
