Plain English

Ithaca, N.Y., Code of Ordinances ch. 210 § 210-82 places a broad set of housing-maintenance duties squarely on lodging house operators and landlords rather than on tenants. The rule covers everything from capping occupancy at permitted levels and keeping common areas safe and sanitary, to maintaining plumbing and appliances, clearing exits, managing garbage, controlling pests throughout the building, and supplying required window screens. When a pest problem extends beyond a single dwelling unit, the responsibility for extermination falls on the operator or landlord, not the individual occupant.

For Property Managers

Under Ithaca, N.Y., Code of Ordinances ch. 210 § 210-82, compliant lodging house operators and landlords generally keep written records of permitted occupancy limits and enforce them, conduct routine inspections of common areas, plumbing, cooking, and refrigeration equipment, and document maintenance and repairs. Operators typically establish a regular schedule for garbage disposal, pest control across the building, and screen installation and removal to stay ahead of code requirements. Keeping exits clear and unencumbered at all times is also a core operational responsibility under this section.

For Tenants

Section 210-82 of Ithaca's Code of Ordinances ch. 210 establishes that many conditions in a lodging house—including sanitation, pest control beyond a single unit, functioning plumbing and appliances, and clear exits—are the landlord's or operator's legal responsibility, not the tenant's. If these conditions are not being met, tenants may have grounds to raise a violation of this provision when responding to eviction proceedings or other landlord actions, or to file a complaint with the City of Ithaca's code enforcement office. Tenant-rights organizations in the Ithaca area can help occupants understand which enforcement paths are available under this section.
