Plain English

Hudson, N.Y., Code of Ordinances ch. 174 § 174-11 establishes a local prohibition on eviction without good cause, adopted under New York State Real Property Law Article 6-a. The rule carves out two key exemptions: rental units whose monthly rent exceeds 345% of the HUD-published fair market rent for Columbia County are not covered, and landlords who own no more than one rental unit anywhere in New York State are classified as 'small landlords' and treated differently under the article. These definitions set the outer boundaries of who and what the good-cause eviction protections apply to in the City of Hudson.

For Property Managers

Under § 174-11, property owners in Hudson should determine whether their units fall within the good-cause eviction framework by checking two thresholds: whether the monthly rent exceeds 345% of the HUD fair market rent for Columbia County as published by the New York State Division of Housing and Community Renewal, and whether they qualify as a 'small landlord' by owning no more than one rental unit statewide. Operators who do not meet either exemption are generally expected to establish a recognized good-cause basis before pursuing eviction. Keeping records of rent levels and unit ownership is a common practice for demonstrating compliance with the exemption criteria set out in § 174-11.

For Tenants

Section 174-11 of Hudson's Code of Ordinances gives tenants in covered units a baseline protection against eviction without good cause, rooted in New York Real Property Law Article 6-a. Tenants whose rent is at or below 345% of the HUD fair market rent for Columbia County, and whose landlord owns more than one unit in New York State, may have grounds to raise a good-cause eviction violation as a defense in a housing proceeding. Tenants seeking to understand whether their unit is covered can consult the New York State Division of Housing and Community Renewal's published rent figures or reach out to a local tenant-rights organization for general guidance.
