Glens Falls, N.Y., Code of Ordinances ch. 128 § 128-4
Compliance required
Operative Text
No person shall occupy as owner-occupant or let or rent to another for occupancy any dwelling, rooming house, dwelling unit or rooming unit for the purpose of living, sleeping, cooking or eating therein which does not comply with the requirements of this chapter.
Section 128-4 of the Glens Falls Code of Ordinances establishes a baseline rule that any residential space used for living, sleeping, cooking, or eating must meet the standards set out in Chapter 128. This applies whether the space is owner-occupied or rented to someone else. No dwelling, rooming house, dwelling unit, or rooming unit is exempt from these requirements simply by virtue of how it is used or who occupies it.

Under Glens Falls Code ch. 128 § 128-4, property owners and managers are generally expected to ensure that every dwelling, rooming house, dwelling unit, or rooming unit they offer for rent or occupy themselves meets all requirements of Chapter 128 before anyone moves in. Compliant operators typically conduct regular inspections and address any deficiencies before a unit is made available for occupancy. Renting or allowing occupancy of a non-compliant unit is expressly prohibited by this provision.

Section 128-4 of the Glens Falls Code of Ordinances means that tenants have a right to occupy housing that meets the standards of Chapter 128, regardless of the type of dwelling or rental arrangement. If a unit appears to fall short of those standards, tenants may consider documenting the conditions and reaching out to the relevant local code enforcement office in Glens Falls. Tenant-rights organizations can also help residents understand what options may be available when a dwelling does not comply with this chapter.
