Section 128-18 of the Glens Falls Code of Ordinances establishes a tiered penalty structure for violations of Chapter 128. A first offense carries a fine between $150 and $1,000, up to one year of imprisonment, or both, with every 30-day period a violation continues counting as a separate offense. Repeat offenders face escalating consequences: a second conviction brings fines of $300–$2,000 plus attorney's fees, and a third or subsequent conviction raises the minimum fine to $600 (up to $2,000) along with attorney's fees and potential imprisonment.

Operators subject to Chapter 128 of the Glens Falls Code should be aware that § 128-18 imposes meaningful financial and criminal exposure for non-compliance. Compliant property managers typically address any cited deficiency promptly, since each 30-day period a violation persists is treated as an entirely new offense, compounding potential fines rapidly. Repeat violations trigger not only higher fine brackets but also mandatory attorney's fees reflecting the cost of prosecution, making ongoing non-compliance significantly more costly than timely remediation.

Section 128-18 signals that Glens Falls takes Chapter 128 violations seriously by attaching escalating criminal and financial penalties to landlord non-compliance. Tenants who believe a landlord is violating Chapter 128 may report the condition to the local enforcement officer, who has authority to pursue prosecution under this provision. Tenant-rights organizations in the Glens Falls area can help residents understand how the 30-day recurring-offense rule and the repeat-conviction penalty tiers may be relevant to ongoing housing conditions.
