Fulton, N.Y., Code of Ordinances ch. 475 § 475-9
Owner responsibilities
Operative Text
A. The owner shall at all times: (1) Comply with all applicable provisions of any state or local statute, code, regulation or ordinance governing the maintenance, construction, use or appearance of the building, structure or part thereof and the property of which it is part. (2) Keep all public areas of the building, grounds, facilities and appurtenances in a clean, safe and sanitary condition. (3) Make all repairs and arrangements necessary to put and keep the building, structure or part thereof and the appurtenances thereto in as good condition as they were or as required by agreement to have been at the commencement of tenancy; in all cases standards established by law must be met. (4) Maintain all electrical, plumbing and other facilities supplied by the owner in good working order. (5) In multiple-dwelling facilities, provide for sanitary disposal of all rubbish and other garbage set out in accordance with the Solid Waste Ordinance. (6) Be responsible for furnishing adequate heat and hot water supply, except in units with individual heating systems or domestic hot water supply. (In this situation, such systems shall be capable of providing adequate heat and hot water as defined herein.) See § 475-34A , C and E(1) . (7) Maintain walls, floors and ceilings in dwelling units and public places in a clean and sanitary condition. (8) Limit occupancy to the maximum number of persons permitted by code. (9) If a demand for inspection or notice of violation has been served in accordance with the provisions of this chapter, remain subject to the provisions thereof notwithstanding a transfer of title after the date of service of such demand or notice of violation. The continuing liability of such owner shall not be deemed to relieve the new owner from compliance with the provisions of this chapter. (10) Respect the tenants' right of quiet enjoyment. The owner shall not enter the rental premises without reasonable, prior notice to the tenant, except for emergencies or as otherwise allowed by law. B. Where the duty imposed by Subsection A is incompatible with or greater than the duty imposed by other clauses of this chapter, the owner's duty shall be determined by reference to Subsection A . C. To facilitate emergency response, the City of Fulton Code requires all new and existing buildings shall have address and premises identification. The identification shall be legible and placed in a position that is visible from the street or road fronting the property. Identification characters shall contrast with their background. Address numbers shall be Arabic numbers or alphabet letters. Numbers shall not be spelled out. Each character shall be not less than four inches (102 mm) high with a minimum stroke width of 1/2 inch (12.7 mm). Spray painting or brushed painting of numbers or letters is not allowed. Where required by the Code Official, premises and address identification shall be provided in additional approved locations to facilitate emergency response. Where access is by means of a private road and the building cannot be viewed from the public way, a monument, pole or other sign or means shall be used to identify the structure. Premises address identification shall be maintained. (1) Dwelling units and sleeping units code. (a) To facilitate emergency response, the City of Fulton Code requires all dwelling units (aka apartments) and sleeping units (aka rooms in a hotel/motel or etc.) located within a structure shall be appropriately labeled with an identification label by the owner of said structure, and the identification label shall be displayed in such a manner that every entrance to each unit is readily ascertainable. If the entrance into the unit identification label is not readily ascertainable from the exterior of the structure, then a secondary identification label shall be placed upon the building per the building Code Official. Where required by the Code Official, premises and address identification shall be provided in additional approved locations to facilitate emergency response. Unit identification characters shall contrast with their background. Unit numbers shall be Arabic numbers. Numbers shall not be spelled out. Each character shall be not less than four inches (102 mm) high with a minimum stroke width of 1/2 inch (12.7 mm). Where required by the Code Official, premises/address/unit identification shall be provided in additional approved locations to facilitate emergency response. (b) All buildings and structures shall have placed thereon, in a conspicuous space, street numbers, either in the form of figures or lettering, which shall be of contrasting color to the building on which they are placed, so that they are clearly legible from the middle of the road of adjacent streets, avenues, places or highways. Such numbers shall be sized as follows: (c) Premises fee. The owner of the premises that receives an order to remedy to comply with this code shall pay a monthly fee of $250 for every month the building is out of compliance.
Fulton, N.Y., Code of Ordinances ch. 475 § 475-9 sets out a broad list of ongoing responsibilities that property owners must meet at all times. These include keeping common areas clean and safe, maintaining electrical and plumbing systems in working order, providing adequate heat and hot water, respecting tenants' right to quiet enjoyment, and ensuring buildings display clearly legible address and unit identification markers to aid emergency responders. Owners who receive a notice of violation remain bound by the code's requirements even if they sell the property, and the incoming owner is equally obligated to comply.

Under Fulton, N.Y., Code of Ordinances ch. 475 § 475-9, compliant property operators routinely inspect and repair electrical, plumbing, heating, and hot-water systems; keep all common areas and dwelling-unit surfaces clean and sanitary; and ensure garbage disposal meets the Solid Waste Ordinance. They also post clearly legible Arabic-numeral address numbers and unit identification labels—at least four inches high with a minimum stroke width of one-half inch—in positions visible from the street and at each unit entrance. Operators are mindful that a notice of violation or demand for inspection issued before a property sale continues to bind them, and that the new owner is independently required to achieve compliance as well.

Section 475-9 of Fulton's housing code gives tenants the right to a well-maintained dwelling, including functioning utilities, clean common areas, adequate heat and hot water, and a landlord who provides reasonable prior notice before entering—except in genuine emergencies. If an owner is not meeting these obligations, tenants may document conditions and report concerns to the City of Fulton's code enforcement office, which has authority to issue orders to remedy and assess ongoing monthly fees for continued non-compliance. Tenants may also wish to contact a local tenant-rights organization to understand the full range of options available under ch. 475 § 475-9.
