Fulton, N.Y., Code of Ordinances ch. 475 § 475-7
Variances and modifications
Operative Text
A. The Bureau Chief is authorized to vary or modify provision(s) of this chapter upon application of the owner or the owner's representative, provided that the intent of such provision(s) shall be maintained and the health and safety of the public assured. B. All such applications for variances or modifications and the decisions of the Bureau Chief shall be in writing. C. The Bureau Chief may approve alternative materials or methods of construction when the proposed design is proven to be satisfactory and to comply with the intent of this chapter and the material or method proposed is, for the purpose intended, equivalent in quality, strength, effectiveness, fire resistance, durability and safety. D. The Bureau Chief shall require that sufficient technical data be submitted to substantiate the proposed use of any material or assembly, and if it is determined that the evidence submitted is satisfactory proof of performance for the use intended, the Bureau Chief shall approve the use of such material or assembly subject to the requirements of this chapter.
Section 475-7 of Fulton, N.Y., Code of Ordinances ch. 475 establishes a formal process by which the Bureau Chief may grant variances or modifications to the chapter's requirements when an owner or their representative submits a written application. Any approved deviation must still uphold the underlying intent of the provision and protect public health and safety. The Bureau Chief may also accept alternative building materials or construction methods if they are demonstrated to be equivalent in quality, strength, fire resistance, durability, and safety to what the code otherwise requires, provided sufficient technical data supports that conclusion.
Plain English — not legal advice.
Under § 475-7, property owners or their representatives who wish to deviate from a standard requirement of ch. 475 generally submit a written application to the Bureau Chief explaining how the proposed variance or alternative material still meets the chapter's intent and protects public health and safety. Operators seeking approval for alternative construction materials or methods typically prepare and submit technical data—such as test results, engineering reports, or manufacturer specifications—sufficient to demonstrate equivalency in quality, strength, fire resistance, durability, and safety. Keeping copies of all written applications and the Bureau Chief's written decisions is a standard practice for maintaining a clear compliance record under this section.

Section 475-7 gives the Bureau Chief authority to approve variances or alternative construction methods in a property, but only when the core intent of ch. 475 and public health and safety standards are maintained. Tenants who have concerns about whether a variance or alternative material approved at their building actually meets those standards may request copies of the written application and the Bureau Chief's written decision, since the provision requires both to be documented in writing. Tenant-rights organizations or a housing attorney can help residents understand what those records mean and what options may be available if they believe a modification falls short of the chapter's health and safety requirements.
