Fulton, N.Y., Code of Ordinances ch. 475 § 475-54
Lead paint
Operative Text
A. No owner or occupant shall use a paint containing more than 0.06 of 1% of metallic lead, based on the total nonvolatile content of the paint, on the interior of any apartment or room in any dwelling to which this chapter applies or in any location accessible to children on the interior or exterior of any said dwelling. B. An owner shall be deemed in compliance with this section if he removes paint containing more than 1% of metallic lead from the aforesaid surfaces of a dwelling and recovers such surfaces with a paint containing less than 1% of metallic lead. However, an owner may cover surfaces on which paint containing more than 0.06 of 1% of metallic lead is present without removing such paint first, if the material and the method used to cover the surface are approved by the Bureau.
Section 475-54 of Fulton, N.Y., Code of Ordinances ch. 475 restricts the use of high-lead paint in dwellings covered by the chapter. Specifically, paint containing more than 0.06% metallic lead (by nonvolatile content) may not be applied to interior spaces or to any area accessible to children on the interior or exterior of such dwellings. An owner can achieve compliance either by removing paint that exceeds 1% metallic lead and repainting with a lower-lead product, or by covering the high-lead surface with an approved material and method without prior removal.

Property owners and managers subject to ch. 475 § 475-54 generally ensure that any paint applied to covered dwellings—especially in child-accessible areas—contains no more than 0.06% metallic lead by nonvolatile content. Compliant operators who have existing surfaces with lead paint above 1% either strip and repaint with a qualifying low-lead product or use a covering material and method that has been approved by the Bureau before proceeding. Maintaining documentation of paint specifications and any Bureau approvals for covering methods is a practice commonly associated with demonstrating compliance under this section.

Section 475-54 gives tenants in covered Fulton dwellings a basis to raise concerns if an owner applies or maintains high-lead paint in interior spaces or in areas accessible to children. Tenants who believe this provision is being violated may consider documenting the condition, contacting the local code enforcement or housing authority responsible for ch. 475, or reaching out to a tenant-rights organization familiar with New York housing law. Multiple general enforcement paths exist, including raising a violation as a defense in a housing proceeding or filing a complaint with the appropriate municipal authority.
