Section 475-44 of Fulton's Code of Ordinances establishes requirements for elevators, dumbwaiters, and moving stairs in residential buildings. These vertical transportation systems must be regularly inspected and kept in working order under both local and New York State codes. Multi-story buildings built specifically for senior citizens after this section's adoption must include elevator access between floors, and all elevator areas—including hoistways, pits, and machine rooms—must be kept clean, free of debris, and clear of flammable or combustible materials. Warning signs directing occupants to use stairs during a fire must also be posted at elevator landings.

For Property Managers

Property owners and managers subject to § 475-44 generally schedule routine inspections of elevators, dumbwaiters, and escalators in compliance with both the Fulton Elevators and Escalators Code and the New York State Uniform Fire Prevention and Building Code. Compliant operators keep hoistways, pits, and machine rooms free of rubbish, oily rags, grease, and flammable liquids, and ensure that no unnecessary materials are stored in machine rooms. Buildings newly constructed for senior citizens with two or more stories are expected to include elevator access, and operators post required fire-emergency stairway warning signs at all elevator landings as specified in § 475-44.

For Tenants

Under § 475-44, tenants in multi-story buildings—particularly those built for senior citizens—have a right to elevator access and to properly maintained, inspected vertical transportation equipment. If elevators appear poorly maintained, lack required fire-emergency warning signs, or machine rooms appear to contain hazardous materials, tenants may document the conditions and report concerns to the City of Fulton's code enforcement or building inspection office. Tenant-rights organizations familiar with New York housing law can help residents understand how § 475-44 applies to their building and what remedies may be available.
