Responsibilities of operators
Operative Text
Operators of premises shall be responsible for compliance with the provisions of this article and the housing standards in regard to the following: (a) Limiting occupancy to the maximum number of persons permitted, and prohibiting unlawful uses; (b) Posting required statement of the maximum number of occupants permitted; (c) Maintenance of the premises in a clean, safe and sanitary condition; (d) Maintenance and operation of service facilities in good order and condition; (e) Maintenance of plumbing, heating and electrical equipment and systems, appliances, fixtures, as well as other building equipment and facilities, in an appropriate, good operative, clean and sanitary condition; (f) Maintenance of walls, floors and ceilings in a clean and sanitary condition; (g) Keeping exits free and clear; (h) Disposing of garbage, refuse and junk in a safe and sanitary manner, and keeping the premises free and clear therefrom, and broom clean; (i) Extermination of insects, vermin, rodents, pests, and elimination of harborage; and (j) Hanging and removing of screens.
Elmira Code ch. 8, art. V § 8-522 establishes a broad set of maintenance and operational responsibilities that fall on the operators of residential premises. The rule covers everything from capping occupancy at permitted levels and posting occupancy notices, to keeping plumbing, heating, and electrical systems in working order, controlling pests, managing garbage disposal, and ensuring exits remain unobstructed. Operators are also required to maintain walls, floors, ceilings, and common service facilities in clean, safe, and sanitary condition, and to handle the installation and removal of window screens.

Under Elmira Code ch. 8, art. V § 8-522, compliant property operators generally maintain written and posted notices of maximum occupancy, conduct regular inspections of mechanical systems—plumbing, heating, and electrical—and address deficiencies promptly. They establish consistent garbage and refuse disposal routines, implement pest-control programs, and keep all exits clear of obstructions at all times. Operators also track the seasonal hanging and removal of screens as part of routine property upkeep to remain in alignment with the article's housing standards.

Elmira Code ch. 8, art. V § 8-522 places the compliance burden squarely on property operators, meaning tenants have a basis to raise concerns when conditions such as pest infestations, broken mechanical systems, blocked exits, or inadequate garbage disposal go unaddressed. Tenants who observe violations of these standards may report them to the appropriate Elmira housing or code enforcement authority, which has the power to inspect and require corrective action. Tenant-rights organizations familiar with local Elmira housing code can help residents understand what documentation to gather and what options are generally available when an operator falls short of these obligations.
