Definitions
Operative Text
The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Agent means the designated representative of an owner, lessor, operator, occupant or person, as filed with the agency. Lessor means the grantor of a lease interest in premises. Occupant means the person in occupancy, in possession, or in control of premises, or using the premises. Operator means the person engaged in the activity of renting or providing space or premises for occupancy or used by others. Owner means the person exercising dominion or control over, or vested with title in, premises; a proprietor (legal owner, joint owner, part owner, record owner, equitable owner, reputed owner or their successors in interest); or the respective agent of any of them. Person means the owner, lessor, operator or occupant of premises, or any firm or corporation, directly or indirectly in control of premises. Premises means the land (improved or unimproved), place, property, buildings, structures, equipment, facilities, and improvements, if any.
Elmira Code ch. 8, art. V § 8-476 establishes the official definitions for key terms used throughout the housing division it governs. Words like "owner," "operator," "lessor," "occupant," "agent," "person," and "premises" each carry specific legal meanings that apply whenever those terms appear in the division. These definitions are broad and inclusive — for example, "owner" covers not just the record titleholder but also joint owners, equitable owners, and their successors, while "premises" encompasses land, buildings, structures, and related improvements.

Property owners and managers operating under Elmira Code ch. 8, art. V should be aware that § 8-476 defines "owner" expansively to include record owners, equitable owners, joint owners, and their agents or successors — meaning responsibility under this division can attach to a wide range of parties with control over a property. Compliant operators typically ensure that any designated agent is properly filed with the relevant agency, as the definition of "agent" specifically references that filing requirement. Understanding these definitions helps operators correctly interpret their obligations throughout the rest of the division.

Elmira Code ch. 8, art. V § 8-476 is relevant to tenants because the broad definition of "occupant" — covering anyone in possession, occupancy, or control of premises — may affect how rights and responsibilities are assigned under the division. Similarly, the expansive definition of "owner" means that tenants may have recourse against multiple parties, not just the person who signed the lease, when a violation occurs. Tenants who believe a provision of this division applies to their situation may wish to consult a local tenant-rights organization or legal aid office for guidance on how these definitions interact with their specific circumstances.
