Plain English

Elmira Code ch. 8, art. V § 8-474 establishes the scope of Division 7's applicability, tying it to the premises and requirements covered by Divisions 1 through 6 of the same article. Properties that were already out of compliance when the underlying ordinance took effect are generally given up to one year to come into conformance, rather than being required to comply immediately. However, that grace period does not apply to buildings or structures deemed dangerous or unsafe — those must be brought into compliance promptly.

For Property Managers

Under Elmira Code ch. 8, art. V § 8-474, property owners whose buildings were not in full compliance at the time the ordinance took effect may have had up to one year to complete the necessary alterations or installations. Compliant operators track whether their properties fall under Divisions 1 through 6 of Article V and document any remediation work undertaken during that transition window. Critically, any property flagged as dangerous or unsafe does not benefit from the extended timeline and requires immediate corrective action.

For Tenants

Elmira Code ch. 8, art. V § 8-474 means that tenants living in properties covered by Divisions 1 through 6 of Article V are protected by the standards set out in those divisions, even if a landlord was given a transitional period to achieve full compliance. If a building has been identified as dangerous or unsafe, the provision requires prompt — not delayed — corrective action by the property owner. Tenants who believe their building remains out of compliance may consider contacting the Elmira Code Enforcement office, raising the violation in any relevant housing proceeding, or reaching out to a local tenant-rights organization for general information about available options.
