Elmira, N.Y., Code ch. 8, art. V § 8-327
Nonapplicability
Operative Text
(a) This article shall not apply to mobile housing premises or migrant housing premises, or to nursing, convalescent and old-age homes, or similar institutional occupancies. (b) This article shall not apply to fallout shelters constructed or installed to provide safety and security to occupants in accordance with specifications and standards contained in regulations or orders issued by the state civil defense commission, or other analogous or successor body.
Elmira Code ch. 8, art. V § 8-327 carves out specific categories of housing and facilities from the requirements of Article V. Mobile housing premises, migrant housing premises, nursing homes, convalescent homes, old-age homes, and similar institutional occupancies are all excluded from the article's coverage. Additionally, fallout shelters built or installed in compliance with state civil defense commission standards—or those of any successor body—are likewise exempt from the article's rules.
Plain English — not legal advice.
Operators of properties covered by Elmira Code ch. 8, art. V § 8-327's exemptions—such as mobile housing, migrant housing, or licensed nursing and convalescent facilities—generally confirm whether their specific property type falls outside Article V's scope before assuming compliance obligations do not apply. Operators of fallout shelters built to state civil defense commission specifications similarly document that construction meets the referenced standards in order to rely on that exemption. Landlords whose properties do not clearly fit one of these excluded categories typically treat Article V's requirements as fully applicable.

Elmira Code ch. 8, art. V § 8-327 means that residents of mobile housing, migrant housing, nursing homes, old-age homes, and similar institutional settings may not have the protections of Article V available to them. Tenants who are uncertain whether their housing type falls within one of these exemptions can review the provision directly or reach out to a local tenant-rights organization for general information about which rules apply to their situation. If a tenant believes an exemption is being claimed incorrectly, raising that question with the appropriate local housing authority or a tenant-advocacy group is one general path for seeking clarification.
