Cohoes, N.Y., Code of Ordinances ch. 148 § 148-8
Discrimination in the provision of brokerage services
Operative Text
It shall be unlawful within the City of Cohoes to deny any person access to or membership or participation in any multiple listing service, real estate broker's organization or other service, organization or facility relating to the business of selling or renting dwellings or to discriminate against him in the terms or conditions of such access, membership or participation on account of race, color, religion, sex, handicap, familial status or national origin.
Section 148-8 of the Cohoes Code of Ordinances prohibits anyone operating real estate brokerage services within the City of Cohoes from excluding a person from, or treating a person unequally within, a multiple listing service, broker's organization, or similar real estate facility. The protected characteristics that trigger this prohibition include race, color, religion, sex, handicap, familial status, and national origin. The rule applies both to outright denial of access and to discriminatory terms or conditions of participation.
Plain English — not legal advice.
Under Cohoes Code § 148-8, property owners and managers who work with or operate through real estate brokerage organizations are expected to ensure that access to those services is extended equally to all participants regardless of race, color, religion, sex, handicap, familial status, or national origin. Compliant operators generally review their relationships with listing services and broker organizations to confirm that membership and participation policies do not impose differential terms on any protected class. Maintaining documented, neutral criteria for brokerage service participation is a common practice among operators seeking to align with this provision.

Section 148-8 of the Cohoes Code of Ordinances gives individuals the right to equal access to multiple listing services, real estate broker organizations, and related facilities when seeking to rent a dwelling in Cohoes. If a person believes they were denied access or subjected to unequal terms on the basis of a protected characteristic such as race, familial status, or handicap, general enforcement paths include filing a complaint with a fair housing agency, raising the violation through local code enforcement channels, or consulting a tenant-rights or fair housing organization for guidance on available options.
