Canandaigua, N.Y., Code of Ordinances ch. 748 § 748-44
Unpaid fees
Operative Text
Bills for minimum housing standards inspection fees shall be sent to the owner of record, as reflected in the office of the Tax Assessor. The responsibility for payment of the bill shall rest with the owner of record. Failure to pay the fee shall result in imposition and foreclosure of a lien on the property. Unpaid inspection fees shall become and be a lien upon the real property and shall be added to and become a part of the taxes next to be assessed and levied upon such property and shall bear interest at the same rate as taxes and shall be collected and enforced by the same officer and in the same manner as taxes.
Under Canandaigua, N.Y., Code of Ordinances ch. 748 § 748-44, inspection fees related to minimum housing standards are billed directly to the property owner of record as identified by the Tax Assessor's office. If those fees go unpaid, they automatically become a lien against the real property and are folded into the property's tax assessment. The unpaid fees then accrue interest at the same rate as property taxes and are collected through the same enforcement mechanisms used for tax collection, which can ultimately include foreclosure.
Plain English — not legal advice.
Property owners subject to minimum housing standards inspections in Canandaigua should be aware that under § 748-44, inspection fee bills are sent to whoever appears as owner of record with the Tax Assessor. Compliant operators generally ensure that inspection invoices are paid promptly, since any unpaid balance is treated as a tax lien on the property and can compound with interest. Keeping ownership records current with the Tax Assessor's office helps ensure that billing notices reach the right party in a timely manner.

Section 748-44 places the legal obligation for paying minimum housing standards inspection fees squarely on the property owner, not the tenant. Tenants who believe an owner is improperly attempting to pass these fees along to them may find it useful to review the ordinance language and consult a local tenant-rights organization for guidance on available options. Because unpaid fees can result in a tax lien on the property, tenants in buildings with unresolved fee issues may also wish to inquire with the City of Canandaigua about the status of any outstanding liens.
