Canandaigua, N.Y., Code of Ordinances ch. 748 § 748-26
Duties of Corporation Counsel; nonexclusive remedies
Operative Text
A. The Corporation Counsel shall, upon complaint of the head of the Code Enforcement Agency, institute appropriate action to restrain, prevent, enjoin, abate, correct or remove such violation and to take such other legal action as is necessary to carry out the terms and provisions of this chapter. B. The remedies provided for herein shall be cumulative and not exclusive and shall be in addition to any other remedies provided by the Uniform Code or other applicable law, and all remedies may be pursued concurrently or consecutively, and the pursuit of any remedy shall not be construed as an election or the waiver of the right to pursue any and all of the other.
Section 748-26 of Canandaigua's Code of Ordinances establishes that the Corporation Counsel is responsible for taking legal action—such as seeking injunctions, abatements, or corrections—whenever the head of the Code Enforcement Agency files a complaint about a violation. The provision also makes clear that the remedies available under this chapter are cumulative, meaning that pursuing one legal remedy does not prevent the city from simultaneously or subsequently pursuing others. No single enforcement path is treated as a final election that forecloses the remaining options.
Plain English — not legal advice.
Under § 748-26, property owners and managers should understand that a code violation complaint can trigger multiple, concurrent legal actions by the Corporation Counsel—not just a single fine or notice. Compliant operators generally address violations promptly upon receiving any notice from the Code Enforcement Agency, because the city retains the right to layer remedies, including injunctive relief, abatement orders, and any penalties available under the Uniform Code or other applicable law. Resolving issues early reduces exposure to the full range of enforcement tools this provision preserves.

Section 748-26 gives tenants context for how the city of Canandaigua enforces housing code violations: a complaint to the Code Enforcement Agency can prompt the Corporation Counsel to seek court orders, abatements, or other legal remedies on the city's behalf. Because the provision explicitly allows all remedies to be pursued at the same time or in sequence, a single unresolved violation can lead to sustained enforcement pressure. Tenants who believe a violation exists may consider contacting the local Code Enforcement Agency to file a complaint, or reaching out to a tenant-rights organization for guidance on available options.
