Plain English

Under Canandaigua Code ch. 748 § 748-22, property owners bear primary responsibility for meeting minimum housing standards regardless of any private agreements they may have with operators or tenants. Owners must maintain supplied facilities and ensure adequate heat and hot water in multi-unit dwellings, though they are not required to continue individually metered gas or electric service that has been shut off for nonpayment. In buildings of five or more units, a weather-protected information card of at least three by five inches must be posted in a prominent location, listing the owner's name, any designated operator's name, and a contact address and phone number for reporting problems.

For Property Managers

Owners operating under Canandaigua Code ch. 748 § 748-22 generally keep documentation showing that all supplied facilities are properly maintained and that heat and hot water are consistently provided in multi-unit dwellings. Private lease agreements that shift maintenance duties to a tenant or operator do not relieve the owner of legal responsibility under this provision. For buildings with five or more units, compliant operators post a durable, legible information card in a prominent interior or exterior location that includes the owner's name, any designated operator's name, a contact address, and a phone number — and they verify that the card remains readable and weather-protected over time.

For Tenants

Under Canandaigua Code ch. 748 § 748-22, tenants in rental properties have the assurance that the owner — not just an on-site manager — is legally responsible for minimum housing standards, proper facility maintenance, and adequate heat and hot water in multi-unit buildings. In buildings of five or more units, a posted information card should be visible and legible, giving tenants a direct contact name, address, and phone number for reporting maintenance concerns. Tenants who believe these standards are not being met may consider contacting the local code enforcement office, reaching out to a tenant-rights organization, or consulting with an attorney familiar with Canandaigua housing ordinances to understand available options.
