Canandaigua, N.Y., Code of Ordinances ch. 748 § 748-16
A. At the end of the period specified in the violation order or any extension thereof, it shall be the duty of the Code Enforcement Officer to make or cause to be made a reinspection of the dwelling, dwelling unit, rooming house, rooming unit or premises, and if compliance has not been established, appropriate legal action as authorized shall be instituted. B. Whenever the Code Enforcement Officer has notified a property owner in writing of any violation of the minimum housing standards or any other appropriate law, and within two years of that written notification a subsequent Notice of violation or order of violation is issued to the same property owner for a violation of the same code or standard then a repeat inspection fee may be assessed for each subsequent notice of violation or order of violation that is sent to the property owner by the Code Enforcement Officer by regular mail.

Plain English

Section 748-16 of Canandaigua's Code of Ordinances establishes a two-part reinspection framework for housing violations. First, once a violation order's deadline (or any approved extension) passes, the Code Enforcement Officer is required to reinspect the property; if the violation remains uncorrected, legal action may follow. Second, if a property owner receives a written violation notice and then, within two years, is cited again for the same code violation, a repeat inspection fee may be charged for each subsequent notice sent by the Code Enforcement Officer.

For Property Managers

Under § 748-16, compliant property operators generally resolve cited violations before the deadline stated in any violation order, since the Code Enforcement Officer is obligated to reinspect once that deadline expires and unresolved issues can trigger legal proceedings. Operators also keep careful records of any written violation notices they receive, because a second citation for the same code standard within two years can result in a repeat inspection fee assessed for each subsequent notice. Staying current on all minimum housing standards helps avoid the compounding costs that the repeat-violation provision is designed to address.

For Tenants

Section 748-16 gives tenants context for understanding what happens after a housing violation is formally cited: the Code Enforcement Officer must return to check whether the problem was fixed, and if it was not, the city is authorized to pursue legal action. If a landlord has a history of repeat violations of the same standard within a two-year window, that pattern—and the associated repeat inspection fees—may be relevant background when raising a housing-condition concern with local authorities. Tenants who believe a violation has gone unaddressed after its deadline may consider contacting the Canandaigua Code Enforcement Office directly or reaching out to a local tenant-rights organization for general guidance.
