Canandaigua, N.Y., Code of Ordinances ch. 748 § 748-14
Violation order
Operative Text
A. Whenever the Code Enforcement Officer determines that there has been a violation or that there are reasonable grounds to believe that there has been a violation of any provisions of this chapter or any rule or regulation adopted pursuant thereto, the Uniform Code, or any other law or ordinance designated, he shall serve an order requiring correction of such violation or alleged violation upon the person or persons responsible for such violation. B. Such order shall be in writing and shall specify the provision violated and shall provide a reasonable time for compliance and shall be served upon the owner (as defined herein), agent, operator or occupant as the case may require. C. Such order shall be deemed to be properly served upon such owner, agent, operator or occupant if a copy is served upon him personally or if a copy thereof is sent by regular mail, return receipt requested, to the last known address of such persons or if a copy is posted in a conspicuous place in or about the building affected by the order and if a copy is mailed by regular mail on the same day it is posted to the owner, agent, operator or occupant or by such other method authorized by the laws of the State of New York.
Section 748-14 of Canandaigua's Code of Ordinances establishes the process by which the Code Enforcement Officer issues a formal correction order when a violation of Chapter 748, the Uniform Code, or another applicable law is found or reasonably suspected. The order must be written, identify the specific provision at issue, and allow a reasonable period for the responsible party to come into compliance. It can be delivered to an owner, agent, operator, or occupant through personal service, certified mail to the last known address, or conspicuous posting on the affected building combined with same-day regular mail.
Plain English — not legal advice.
Under § 748-14, a compliant property owner or manager maintains current, accurate contact information on file with the municipality so that any correction order can be received without delay. Operators who receive a written violation order generally review the cited provision, document the steps taken to address the identified condition, and complete corrections within the timeframe specified in the order. Keeping records of all correspondence related to a violation order—including mailing receipts and posting notices—supports a clear compliance trail.

Section 748-14 gives occupants a formal role in the correction-order process: an order may be served directly on a tenant when the circumstances require it, meaning tenants can be officially notified of code violations affecting their unit. If a tenant believes a violation exists and no order has been issued, they may contact Canandaigua's Code Enforcement Office to request an inspection or inquiry under Chapter 748. Tenant-rights organizations can help occupants understand how a pending or unaddressed violation order may be relevant to habitability concerns or other housing matters.
