Canandaigua, N.Y., Code of Ordinances ch. 560 § 560-2
Findings and purpose
Operative Text
A. The City Council has determined that there exists in the City of Canandaigua issues arising from the relatively large proportion of residential rental property, which currently accounts for approximately 50% of all residential units in the City. A number of these rental units may, from time to time, be substandard or in violation of the New York State Uniform Fire Prevention and Building Code, the New York State Multiple Residence Law , or other state codes or local codes. The City Council finds that the large number of rental units encourages a transient population, which often accounts for a disproportionate number of complaints of public nuisances, including but not limited to noise, disorderly conduct, and property damage. The City Council also finds that identifying and contacting a responsible party to address code violations, nuisance calls, and emergencies associated with residential rental properties is frequently a challenge for City staff because contact information for the owner or his/her agent is not routinely gathered and updated. B. In light of these findings, the City Council further has determined that it is in the public interest to establish an annual rental property registration program, wherein owners of residential rental property shall provide, annually to the City, contact and other information that will aid staff in identifying a responsible party.
Section 560-2 of Canandaigua's Code of Ordinances sets out the City Council's rationale for creating a mandatory annual rental property registration program. The Council found that rental units make up roughly half of all residential housing in the city, that some of those units may fall short of state and local code standards, and that city staff often struggle to reach a responsible owner or agent when violations or emergencies arise. The provision establishes that collecting and regularly updating owner contact information serves the public interest by making code enforcement and emergency response more effective.
Plain English — not legal advice.
Under § 560-2, the City of Canandaigua has formally tied its registration requirement to the practical need for up-to-date owner and agent contact information. Compliant rental property owners generally ensure that accurate contact details are submitted to the City on an annual basis, so that staff can quickly reach a responsible party in the event of a code violation, nuisance complaint, or emergency. Staying current with this registration obligation reflects the Council's stated goal of maintaining safe, code-compliant housing across the city's large rental stock.

Section 560-2 explains why Canandaigua created its rental registration program — in part because substandard conditions and difficulty reaching property owners have historically been concerns in the city. Tenants living in units that may not meet the New York State Uniform Fire Prevention and Building Code or the Multiple Residence Law can use the existence of this registration framework as a starting point for understanding what accountability mechanisms the city has put in place. Tenants who encounter unsafe conditions or unresponsive landlords may find it useful to contact the City of Canandaigua directly or reach out to a local tenant-rights organization to learn what options are available under ch. 560 and related state codes.
