Batavia, N.Y., Code of Ordinances ch. 143 § 143-7
Penalties for offenses
Operative Text
A. The penalties for a violation of any of the provisions of this chapter shall be as prescribed in Chapter 1 , General Provisions, Article II , General Penalty, of the City of Batavia Municipal Code. In addition to other remedies, the City of Batavia may institute appropriate action to restrain, prevent, enjoin, abate, correct or remove any violation and to take such other legal action as is necessary to carry out the terms and provisions of this chapter. B. The remedies provided for herein shall be cumulative and not exclusive and shall be in addition to any other remedies provided by law; and all remedies may be pursued concurrently or consecutively, and the pursuit of any remedy shall not be construed as an election or waiver of the right to pursue any and all of the others.
Section 143-7 of Batavia, N.Y., Code of Ordinances ch. 143 establishes that violations of the chapter's housing provisions carry penalties set by the City of Batavia's General Penalty ordinance, found in Chapter 1, Article II of the Municipal Code. Beyond monetary penalties, the city is authorized to seek court-ordered relief—such as injunctions or abatement orders—to stop or correct violations. All available remedies can be pursued simultaneously or in sequence, and using one remedy does not forfeit the right to use any other.

Property owners and managers operating under ch. 143 should be aware that § 143-7 ties penalty amounts to the City of Batavia's General Penalty provisions in Chapter 1, Article II, meaning a single unresolved violation can expose an operator to both financial penalties and court-ordered corrective action. Compliant operators generally maintain properties in continuous conformance with ch. 143 requirements so that the city has no basis to pursue any of these cumulative remedies. Because the city may pursue multiple enforcement tracks at once, addressing any identified deficiency promptly is a hallmark of responsible property management.

Under § 143-7 of Batavia, N.Y., Code of Ordinances ch. 143, tenants should know that the city holds broad enforcement authority—including the ability to seek injunctions, abatement, or other court remedies—when housing violations occur, in addition to imposing financial penalties under the General Penalty provisions of Chapter 1, Article II. Because these remedies are cumulative, a single violation can trigger several simultaneous enforcement actions by the city. Tenants who believe a violation exists may consider contacting the City of Batavia's code enforcement office or reaching out to a local tenant-rights organization to understand what complaint or reporting options may be available.
