Auburn, N.Y., Code of Ordinances ch. 182 § 182-64
Unfit dwelling units
Operative Text
Any dwelling, dwelling unit, rooming house or rooming unit having any of the defects found in Subsections A through C herein may be designated by the Housing Code Inspector as unfit for human habitation and may be so placarded. A. The structure lacks illumination, ventilation, sanitation, heat, or other facilities adequate to protect the health and safety of the occupants or the public. B. The structure is damaged, decayed, dilapidated, insanitary, unsafe, or vermin infested in such a manner as to create a serious hazard to the health and safety of the occupants or the public. C. The structure, because of the location, general conditions, state of the premises, or number of occupants, is so insanitary, unsafe, overcrowded, or otherwise detrimental to health and safety that it creates a serious hazard to the occupants or the public.
Auburn, N.Y., Code of Ordinances ch. 182 § 182-64 establishes the conditions under which a residential dwelling, dwelling unit, rooming house, or rooming unit may be officially declared unfit for human habitation. A Housing Code Inspector may make this designation—and post a placard on the property—when the structure lacks adequate illumination, ventilation, sanitation, heat, or other essential facilities, or when it is damaged, decayed, dilapidated, or vermin-infested in a way that poses a serious health or safety hazard. The rule also covers situations where overcrowding, poor general conditions, or the property's location collectively create a serious hazard to occupants or the public.

Under Auburn, N.Y., Code of Ordinances ch. 182 § 182-64, property owners and managers generally maintain their rental units in a condition that avoids the defects enumerated in Subsections A through C—ensuring adequate lighting, ventilation, sanitation, and heat, and keeping structures free from decay, dilapidation, and vermin infestation. Operators who proactively address structural damage, overcrowding, and sanitary conditions reduce the risk of a Housing Code Inspector designating a unit unfit for human habitation and posting a placard. Routine inspections and prompt repairs are the hallmarks of compliant property management under this provision.
