Auburn, N.Y., Code of Ordinances ch. 182 § 182-43 establishes standards for the maintenance of open areas associated with residential and other properties. It requires that water drainage, fences, paved surfaces, yards, ground cover, and vegetation all be kept in safe and serviceable condition. The provision also restricts open burning to situations where local authorization and state air pollution rules are satisfied. Together, these requirements are aimed at preventing physical hazards, health risks, and environmental harm on and around properties.
Plain English — not legal advice.
Under Auburn, N.Y., Code of Ordinances ch. 182 § 182-43, compliant property operators generally ensure that drainage systems prevent water from pooling near structures, that fences and walls are kept structurally sound, and that paved areas such as walks and driveways remain safe for use. Operators also routinely clear yards and vacant lots of hazards, maintain ground cover to control erosion, and remove heavy or noxious vegetation. Any open burning on the property would need to be authorized under local law and consistent with state air pollution control regulations before it takes place.

Section 182-43 of Auburn's Code of Ordinances gives tenants a basis to expect that the open areas of their rental property—including yards, walkways, drainage features, and fences—are maintained in a safe and hazard-free condition. If these standards are not being met, tenants may document the conditions and report concerns to the appropriate Auburn code enforcement or housing inspection office. Tenant-rights organizations can also help residents understand what options are generally available when open-area maintenance issues arise.
