Auburn, N.Y., Code of Ordinances ch. 182 § 182-4
Exemptions
Operative Text
A. This chapter shall not apply to mobile housing premises or migrant housing premises or to nursing, convalescent, and old-age homes or similar institutional occupancies. B. This chapter shall not apply to fallout shelters constructed or installed to provide safety and security to occupants in accordance with specifications and standards contained in regulations or orders issued by the New York State Civil Defense Commission or other analogous or successor body.
Auburn, N.Y., Code of Ordinances ch. 182 § 182-4 carves out certain property types from the requirements of Chapter 182 entirely. Mobile housing premises, migrant housing premises, nursing homes, convalescent homes, old-age homes, and similar institutional occupancies are excluded from the chapter's coverage. Fallout shelters built or installed in compliance with specifications set by the New York State Civil Defense Commission or a successor body are also exempt from the chapter's requirements.
Plain English — not legal advice.
Operators of the property types listed in § 182-4 — including mobile housing, migrant housing, nursing homes, convalescent homes, old-age homes, and qualifying fallout shelters — generally do not need to comply with the substantive requirements of Chapter 182. Compliant operators of fallout shelters typically maintain documentation showing that the shelter was constructed or installed according to New York State Civil Defense Commission standards or those of an analogous successor body. Operators of facilities that fall near the boundary of these exemptions, such as those that blend residential and institutional uses, commonly review whether their property type clearly fits within the categories named in § 182-4.

Residents of mobile housing premises, migrant housing premises, nursing homes, convalescent homes, old-age homes, and similar institutional settings should be aware that § 182-4 places those occupancies outside the scope of Chapter 182's protections. Tenants who are uncertain whether their housing type qualifies for an exemption may find it useful to review the definitions used elsewhere in Chapter 182 or to contact a local tenant-rights organization for general guidance. Those who believe their housing has been incorrectly classified as exempt under § 182-4 may wish to consult with a housing attorney or reach out to the relevant local authority for clarification.
