Albany, N.Y., Code of Ordinances ch. 231 § 231-8
A. Except as provided in §§ 231-104 and 231-126 , the provisions of this code shall supplement local laws, ordinances, codes or regulations. When a provision of this code is found to be inconsistent with any provision of a local law, ordinance, code or regulation, the provision or requirement which is the more restrictive or which establishes the higher standard shall prevail. A greater penalty shall not be considered as more restrictive or a higher standard. B. Notwithstanding the availability of other remedies for enforcement of the provisions contained in the Building Code, Plumbing Code, Electrical Code, Sanitary Code of the Albany County Health District and Zoning Ordinances of the City of Albany, the remedies and enforcement procedures as set forth in this code are made available to enforce the provisions of the aforesaid enumerated City codes and ordinances and shall be deemed cumulative to other procedures and remedies; subject, however, to the provisions of §§ 231-104C and 231-126 of this code. C. The Commissioner of Buildings as Director of Housing shall have the authority to issue such regulations as may be necessary to implement the provisions of this code.

Plain English

Albany, N.Y., Code of Ordinances ch. 231 § 231-8 establishes how the Albany Housing Code interacts with other local laws and codes. When this code conflicts with another local rule, whichever standard is stricter or more protective takes precedence — though a harsher penalty alone does not make a rule 'more restrictive.' The enforcement tools and remedies available under this code can also be used to enforce related city codes, such as the Building, Plumbing, Electrical, and Sanitary Codes, and those remedies stack on top of whatever other enforcement options already exist. The Commissioner of Buildings, acting as Director of Housing, is authorized to issue regulations needed to carry out the code's provisions.

For Property Managers

Under Albany, N.Y., Code of Ordinances ch. 231 § 231-8, property owners and managers operating in Albany should be aware that the Housing Code's requirements layer on top of — and in cases of conflict, may override — other local building, plumbing, electrical, sanitary, and zoning rules, with the stricter standard always controlling. Compliant operators generally track requirements across all applicable city codes, since enforcement authorities can use Housing Code remedies to address violations of those related codes as well. Staying current with any administrative regulations issued by the Commissioner of Buildings under this section is also part of maintaining compliance.

For Tenants

Albany, N.Y., Code of Ordinances ch. 231 § 231-8 means that tenants in Albany benefit from overlapping layers of protection: the Housing Code supplements other city codes, and where they conflict, the stricter rule applies. Enforcement of the Building, Plumbing, Electrical, and Sanitary Codes can be pursued using the same remedies available under the Housing Code, giving tenants and enforcement agencies multiple avenues to address substandard conditions. Tenants who believe their housing conditions violate any of these codes may consider contacting the Albany Commissioner of Buildings or a local tenant-rights organization to understand which remedies and complaint processes may be available to them.
