Albany, N.Y., Code of Ordinances ch. 231 § 231-7
Nonapplicability
Operative Text
A. Whereas, mobile homes, mobile home courts, tourist camps, farm labor camps, travel trailers and trailer parks are not permitted for dwelling purposes within the boundaries of the City of Albany; and B. Whereas, housing standards applicable to nursing and convalescent homes have been established and regulated by the State of New York; therefore C. The provisions of this section are hereby deleted from this code.
Albany City Code ch. 231 § 231-7 formally removes certain housing-standards provisions from the local code on two stated grounds: first, that mobile homes, mobile home courts, tourist camps, farm labor camps, travel trailers, and trailer parks are not permitted as dwellings within Albany's city limits; and second, that nursing and convalescent home standards are already governed at the state level by New York. The net effect is that the deleted provisions no longer carry local regulatory force within Albany.

Operators and property managers in Albany should be aware that ch. 231 § 231-7 eliminates specific local housing-standard provisions that once applied to mobile homes, trailer parks, and similar dwelling types, as well as to nursing and convalescent facilities. Because those categories are either prohibited within city limits or governed by state law, compliant operators of conventional rental housing look to the remaining sections of ch. 231 and applicable New York State regulations for their obligations. Managers of nursing or convalescent facilities in particular should consult state-level standards rather than this local code section.

Tenants should understand that ch. 231 § 231-7 removes certain local housing provisions from Albany's code, meaning the protections or standards those provisions once described are no longer enforceable at the local level for the covered dwelling types. Residents of nursing or convalescent homes may find that relevant housing standards are set and enforced by the State of New York rather than the City of Albany. Tenants seeking to understand which rules apply to their specific housing type may find it useful to consult a tenant-rights organization or review the remaining provisions of ch. 231 alongside applicable state regulations.
