Albany, N.Y., Code of Ordinances ch. 231 § 231-6 defines the range of properties and structures that fall under Albany's residential property maintenance code. The rule covers a broad spectrum of residential settings—from single-family homes and two-family dwellings to rooming houses, multiple dwellings, mixed-use buildings, and hotels and motels—as well as the land and accessory structures associated with them. Certain properties are carved out by a separate provision, § 231-7, which lists specific exclusions.

For Property Managers

Property owners and managers operating in Albany should be aware that § 231-6 casts a wide net, bringing nearly all residential and mixed-use properties—including accessory structures and short-term lodging facilities such as hotels and motels—within the scope of the city's property maintenance code. Compliant operators generally confirm whether their specific property type falls within the categories listed in § 231-6 and review § 231-7 to determine whether any exclusions apply. Maintaining familiarity with the full scope of the code helps operators understand which maintenance and habitability standards apply to their holdings.

For Tenants

Tenants living in a wide range of housing types in Albany—from single-family rentals and rooming houses to units in mixed-use buildings—should know that § 231-6 brings their residence within the scope of the city's residential property maintenance code. This means the standards established elsewhere in ch. 231 generally apply to their living conditions. Tenants who believe their housing does not meet applicable standards may consider contacting Albany's code enforcement office, reaching out to a local tenant-rights organization, or reviewing § 231-7 to understand whether any exclusions might affect their situation.
