Albany, N.Y., Code of Ordinances ch. 231 § 231-136 establishes that anyone who knowingly and willfully violates the relevant housing provisions—or who helps another person do so—or who ignores a Department notice and order, faces criminal punishment upon conviction as defined in Chapter 133A of the Albany City Code. The provision also makes clear that the City retains the independent authority to pursue New York State building code violations and Albany City Code violations through that same Chapter 133A framework. In other words, this section does not limit the City's broader enforcement toolkit; multiple overlapping violations can be pursued simultaneously.

For Property Managers

Property owners and managers subject to Albany, N.Y., Code of Ordinances ch. 231 § 231-136 should be aware that compliance extends beyond passive non-violation—actively assisting someone else in circumventing the rules can itself trigger liability upon conviction. Operators who receive a notice and order from the Department are generally expected to respond and remedy the identified issue within the timeframe specified, since failure to comply is independently punishable. Because § 231-136 also preserves the City's right to enforce state building codes and local ordinances under Chapter 133A, a single property situation can give rise to multiple enforcement actions at once.

For Tenants

Under Albany, N.Y., Code of Ordinances ch. 231 § 231-136, tenants should know that the City has the authority to pursue criminal penalties against landlords or other parties who knowingly violate the housing provisions covered by this part, including those who ignore Department notices and orders. The provision also preserves the City's ability to enforce New York State building codes and Albany's own code independently, meaning a landlord's conduct may be subject to enforcement on several fronts simultaneously. Tenants who believe a violation has occurred may consider contacting the Albany Department of Buildings and Regulatory Compliance, reaching out to a local tenant-rights organization, or consulting with a housing attorney to understand what reporting or complaint options may be available.
