Plain English

Albany, N.Y., Code of Ordinances ch. 231 § 231-100 establishes that operators of rooming and lodging houses bear direct responsibility for a broad set of property conditions. These include keeping occupancy within permitted limits, maintaining safe and sanitary conditions throughout the premises, ensuring exits remain clear, and managing pest control, garbage disposal, screens, plumbing, and cooking and refrigeration equipment. The rule places these obligations squarely on the operator rather than distributing them among individual occupants.

For Property Managers

Under Albany, N.Y., Code of Ordinances ch. 231 § 231-100, compliant rooming and lodging house operators generally track occupancy counts against the code-permitted maximum, conduct routine inspections of common areas, plumbing, and appliances, and maintain documented pest-control and refuse-disposal programs. Operators also keep exit pathways clear at all times and ensure that walls, floors, ceilings, and required screens are in sanitary and functional condition. Maintaining records of maintenance activities and service-facility inspections is a common practice among operators seeking to demonstrate ongoing compliance.

For Tenants

Albany, N.Y., Code of Ordinances ch. 231 § 231-100 gives residents of rooming and lodging houses a basis for expecting that their operator—not the individual tenant—is responsible for conditions such as pest control, sanitary common areas, clear exits, functioning plumbing, and proper garbage disposal. If these conditions are not being met, tenants may document the issues in writing and report them to Albany's local code enforcement or housing inspection office. Tenant-rights organizations in the Albany area can also help residents understand what remedies or complaint processes may be available under this provision.
