Albany, N.Y., Code of Ordinances ch. 187 § 187-4
Unlawful discriminatory practices
Operative Text
All such unlawful discriminatory practices contained in the Human Rights Law of the State of New York, as amended, and §§ 296 and 296-a, or Article III of Chapter 48 of this Code, as pertaining to fair housing are hereby restated by the City of Albany as the provision of this chapter. All such procedures as delineated within §§ 296 and 296-a as pertaining to fair housing are hereby replaced by the provisions set forth in § 187-9 of this chapter.
Albany, N.Y., Code of Ordinances ch. 187 § 187-4 incorporates the fair housing provisions of New York State's Human Rights Law—specifically §§ 296 and 296-a—directly into Albany's local code, making those state-level prohibitions on housing discrimination part of Albany's own ordinance. At the same time, the provision replaces the enforcement procedures that would otherwise apply under state law with Albany's own local procedures, found in § 187-9 of the same chapter. The practical effect is that Albany enforces fair housing protections through its own local framework rather than deferring entirely to state mechanisms.
Plain English — not legal advice.
Property owners and managers operating in Albany should be aware that under ch. 187 § 187-4, the fair housing prohibitions drawn from New York State Human Rights Law §§ 296 and 296-a carry the full force of Albany's local ordinance. Compliant operators generally review their tenant screening criteria, advertising practices, and lease terms to ensure they do not discriminate on any basis protected under those incorporated provisions. Because Albany has substituted its own enforcement procedures via § 187-9, operators should familiarize themselves with the local complaint and hearing process rather than assuming state procedures apply.

Under Albany, N.Y., Code of Ordinances ch. 187 § 187-4, tenants in Albany are protected by the same broad fair housing prohibitions found in New York State Human Rights Law §§ 296 and 296-a, now restated as local law. If a tenant believes a landlord has engaged in discriminatory housing practices, Albany's local enforcement procedures under § 187-9 govern how complaints are handled, rather than the state-level process. Tenants may consider reaching out to Albany's local human rights office, a tenant-rights organization, or an attorney familiar with local fair housing law to understand the options available under § 187-9.
