Plain English

Under Omaha, Neb., Code of Ordinances ch. 48, art. II § 48-204, it is unlawful to offer, lease, or continue leasing a rental dwelling unless the property has been registered with the city's permits and inspections division. Registration remains valid until ownership of the property changes hands, but it does not become a one-time formality — landlords must maintain continuous compliance with applicable codes, including the International Property Maintenance Code (IPMC), for the registration to stay in effect. Failures to comply can trigger a range of enforcement responses, from notices and orders to fines, citations, and even criminal prosecution.

For Property Managers

Omaha, Neb., Code of Ordinances ch. 48, art. II § 48-204 makes registration with the permits and inspections division a prerequisite before any rental dwelling may be offered or leased. Compliant operators typically register before marketing or renting a unit, keep the registration current through any required periodic inspections, and address code deficiencies promptly to avoid enforcement actions such as fines or citations. When a property is sold or transferred, the registration does not carry over to the new owner, so operators involved in a transfer should account for re-registration requirements.

For Tenants

Omaha, Neb., Code of Ordinances ch. 48, art. II § 48-204 establishes that a landlord may not lawfully lease a dwelling that has not been registered with the city's permits and inspections division. Tenants who believe their rental unit is unregistered or that their landlord is failing to maintain required code compliance may have grounds to raise those issues with the city's permits and inspections division or to consult a tenant-rights organization familiar with Omaha housing law. Because ongoing compliance — including periodic inspections — is a condition of valid registration, documented code violations can be relevant to understanding a landlord's registration status.
