Lincoln, Neb., Mun. Code ch. 21.50 § 21.50.010
Purpose
Operative Text
The City Council of the City of Lincoln, Nebraska, having found and determined that there is an increasing percentage of residential rental units in other cities that have been converted to condominiums , and that a portion of the City of Lincoln's rental housing is presently being converted to condominium status; that it is necessary for the city to obtain accurate information regarding the effect of such conversions on available rental housing within the city; that the prospective purchasers of such condominium units are often without knowledge of the unique concepts of ownership involved; and that tenants, particularly elderly tenants, are displaced without adequate time and ability to obtain replacement housing, thus creating a situation detrimental to the health, safety, and welfare of the people of the City of Lincoln, it is necessary and appropriate for the city to require that sellers of condominium units to prepare and file information relative to such condominium conversions and to provide adequate notice to tenants in buildings intended for conversion. (Ord. 12795 §1; January 21, 1980).
Section 21.50.010 of the Lincoln Municipal Code establishes the purpose behind the city's condominium conversion regulations. The City Council identified that residential rental units were being converted to condominiums at a growing rate, leaving tenants—especially elderly residents—without enough time or resources to find replacement housing. To address this, the provision sets the foundation for requiring sellers to file information about conversions and to give tenants adequate advance notice before a building is converted.
Plain English — not legal advice.
Under Lincoln, Neb., Mun. Code § 21.50.010, the city's regulatory framework for condominium conversions is grounded in a finding that such conversions can harm tenants and the broader rental housing supply. Operators who convert residential rental buildings to condominiums are generally expected to prepare and file the required informational disclosures with the city. Compliant property owners also ensure that tenants receive proper advance notice of any intended conversion, consistent with the purposes articulated in this chapter.

Section 21.50.010 of the Lincoln Municipal Code reflects the City Council's recognition that tenants—particularly elderly residents—can be seriously harmed when rental buildings are converted to condominiums without sufficient warning. This provision forms the basis for tenant protections found throughout Chapter 21.50, including rights to notice and information before a conversion takes place. Tenants who believe they have not received required disclosures or adequate notice may wish to contact the City of Lincoln or a local tenant-rights organization to understand what remedies may be available under this chapter.
