Penalty For Violations.*
Operative Text
Any person upon whom a duty is placed by the provisions of this title who shall fail, neglect, or refuse to perform such duty, or who shall violate any of the provisions of this title, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not to exceed $500.00 or be imprisoned in the county jail for a period not to exceed six months, or both, except that each person so convicted shall be fined in a sum of not less than $200.00 for the first offense, not less than $250.00 for a second offense, and not less than $300.00 for the third offense and each offense thereafter. The penalty herein provided shall be cumulative with and in addition to the revocation, cancellation, or forfeiture of any license, permit, or right elsewhere provided for violation thereof or as provided by law. Each day that a violation of this title continues shall constitute a separate and distinct offense and shall be punishable as such. (Ord. 19101 §1; July 7, 2008: prior Ord. 15654 § 24; July 9, 1990). *Editor's Note: Chapters 21.52 and 21.56, which were added to this title during the 1991 recodification, are excluded from the provisions of Chapter 21.48 .
Lincoln Municipal Code § 21.48.030 establishes criminal penalties for anyone who fails to fulfill a duty or violates any provision of Title 21. A violation is treated as a misdemeanor, carrying a fine of up to $500 and/or up to six months in county jail, with mandatory minimum fines that escalate from $200 for a first offense to $250 for a second and $300 for a third or subsequent offense. Importantly, each day a violation continues counts as a separate offense, and these penalties stack on top of any license, permit, or right revocations that may also apply. Note that Chapters 21.52 and 21.56 are excluded from this penalty framework.
Plain English — not legal advice.
Property owners and managers subject to Title 21 in Lincoln should be aware that § 21.48.030 treats every day of non-compliance as a distinct misdemeanor offense, meaning fines can accumulate rapidly. Compliant operators generally address any identified deficiency promptly to avoid escalating mandatory minimums, which increase with each successive conviction. Because penalties under this section are cumulative with license or permit revocations, operators typically maintain thorough records of corrective actions taken in response to any notice of violation.

Tenants living in properties subject to Lincoln's Title 21 should know that § 21.48.030 gives the city a criminal enforcement mechanism against landlords or other duty-holders who fail to comply with the title's requirements. If a landlord's non-compliance persists, each additional day can be charged as a separate offense, which may strengthen the city's enforcement posture over time. Tenants who believe a violation is occurring can report concerns to the relevant local code enforcement office, and may also wish to consult a tenant-rights organization to understand what options are available to them.
