Plain English

Lincoln Municipal Code § 21.05.140 amends Section 107.3 of the International Property Maintenance Code to establish the methods by which official property maintenance notices are considered legally delivered. A notice is valid if it is handed directly to the recipient, sent by certified or first-class mail to the address on file with the County Assessor, or — if mail is returned undelivered — posted visibly on or near the affected structure. This provision ensures that property owners cannot avoid notice simply by having an outdated mailing address or by failing to collect mail.

For Property Managers

Under Lincoln Mun. Code § 21.05.140, compliant property operators generally keep their contact address current with the County Assessor, since that is the address the city will use when sending official property maintenance notices by mail. If a mailed notice is returned undelivered, the city is authorized to post the notice directly on the affected structure, which still constitutes valid legal service. Operators who maintain accurate records with the County Assessor are better positioned to receive timely notice and respond within any required timeframes.

For Tenants

Lincoln Mun. Code § 21.05.140 governs how official notices about a property's maintenance conditions are formally served, which can be relevant to tenants who want to understand whether a landlord has been properly notified of code violations. If a notice has been personally delivered, mailed, or posted on the building, it is considered legally served under this provision — meaning a landlord cannot claim ignorance of an official order. Tenants who believe property maintenance violations are going unaddressed may find it useful to contact the Lincoln-Lancaster County Health Department or a local tenant-rights organization to understand how this notice process applies to their building.
