Lincoln, Neb., Mun. Code ch. 11.06 § 11.06.090
Complaint; Failure to Show Housing; Order
Operative Text
If a complaint is based on an alleged failure to show housing, the commission , after investigation and determination that probable cause exists for crediting the allegation in the complaint, shall at the direction of the chairperson of the commission issue a written order upon the respondent named in the complaint that the housing involved be shown to the complainant . Such written order shall be final and not subject to review by the commission. If the respondent refuses without good cause to comply with such order within three days, the chairperson of the commission, in their discretion, may refer such order together with a full written report of the facts to the City Attorney for the institution of such action as the City Attorney may deem necessary, which may include the filing of a petition for injunctive relief in the district court seeking enforcement of such order. In such cases, if the court finds that the refusal to show is based on an unfair housing practice, the City Attorney shall request a court order directing the respondent to immediately show such housing and to make full disclosure to the public of all information concerning such housing. (P.C. §11.06.100: Ord. 12849 §22; February 19, 1980: Ord. 12151 §25; November 21, 1977: Ord. 10917 §2; October 1, 1973).
Lincoln Municipal Code § 11.06.090 establishes a process for handling complaints alleging that a housing provider refused to show a property to a prospective occupant. When the commission finds probable cause supporting such a complaint, it can issue a binding written order requiring the housing to be shown — an order that cannot be appealed back to the commission. If the respondent refuses to comply within three days without good cause, the matter may be referred to the City Attorney, who can seek a court injunction and, if a court finds an unfair housing practice occurred, compel the respondent to show the housing and publicly disclose all related information about it.
Plain English — not legal advice.
Under § 11.06.090, housing providers in Lincoln who receive a commission order to show a property must comply within three days or risk referral to the City Attorney and potential court action. Compliant operators generally document all showings and communications with prospective tenants to demonstrate that access to housing is being offered on a non-discriminatory basis. Maintaining clear, consistent showing policies helps operators avoid the probable-cause findings that trigger this provision's enforcement pathway.

Section § 11.06.090 of the Lincoln Municipal Code gives prospective tenants a formal avenue to challenge a refusal to show housing by filing a complaint with the commission. If the commission finds probable cause, it can issue a binding order requiring the housing to be shown, and if that order is ignored, the City Attorney may pursue court enforcement including public disclosure of housing information. Tenants who believe they have been denied a showing on discriminatory grounds may consider contacting the commission directly or reaching out to a local fair-housing or tenant-rights organization to understand available options.
