Each dependent mobile home space shall contain not less than 1,000 square feet and shall be at least 25 feet wide. (C) (1) Independent mobile home spaces in existence on the effective date of this chapter which have a width or area less than the minimum prescribed above may continue to operate for a period not to exceed three years from the effective date of this chapter; provided, that the city administrator finds: (a) That immediate compliance with such minimum width and area requirements would constitute an unreasonable hardship. (b) That the owner is undertaking action reasonably calculated to comply with such requirements during the time prescribed herein. (2) Upon such a finding, the city administrator may issue a temporary permit pending such corrective action. (1964 Code, § 13A-11)
Bellevue, Neb., Code of Ordinances ch. 17, art. II § 17-22 establishes physical layout standards for mobile home spaces within mobile home parks. Each space must have direct access to a public street, maintain at least 15 feet of clearance between mobile homes, and stay at least 10 feet from the park's exterior boundary. Independent spaces must be at least 2,500 square feet and 40 feet wide, while dependent spaces must be at least 1,000 square feet and 25 feet wide. Spaces that were smaller than these minimums when the chapter took effect could continue operating for up to three years if the city administrator found that immediate compliance would be an unreasonable hardship and that the owner was actively working toward compliance.
Plain English — not legal advice.
Operators of mobile home parks in Bellevue are generally expected to ensure that every space covered by Bellevue, Neb., Code of Ordinances ch. 17, art. II § 17-22 meets the prescribed size, width, setback, and access requirements before placing a mobile home on it. Compliant park operators typically document that each independent space reaches the 2,500-square-foot and 40-foot-width minimums, and that spacing between homes and from the park boundary is maintained. Owners of pre-existing undersized spaces who believe immediate compliance would be an unreasonable hardship may seek a temporary permit from the city administrator, provided they can demonstrate active steps toward bringing the space into conformance within the allowable period.
