Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-64
SAME—MINIMUM FLOOR AREA FOR OCCUPANCY BY MORE THAN ONE OCCUPANT
Operative Text
No dwelling unit containing less than 180 square feet of habitable room floor area shall be occupied by more than one occupant; provided, that if a dwelling unit consisting of only one habitable room has a closet with a minimum ceiling height of six feet, contained within the dwelling unit and connected thereto with a doorway or other similar opening, the actual floor area of the closet, up to and including a maximum of 20 square feet shall be included in computing the habitable room floor area of the dwelling unit. (1964 Code, § 12A-19)
Section 15-64 of Bellevue, Nebraska's Code of Ordinances establishes a minimum habitable floor area of 180 square feet before a dwelling unit may be occupied by more than one person. A limited exception applies to single-room units: if the unit contains a closet with a ceiling height of at least six feet and a doorway or similar opening connecting it to the main room, up to 20 square feet of that closet's floor area may be counted toward the 180-square-foot threshold. This rule is designed to set a baseline standard for occupancy density in the interest of habitability and safety.

Under § 15-64, operators of rental properties in Bellevue, Nebraska generally verify the habitable floor area of each dwelling unit before permitting more than one occupant to move in. For single-room units that fall just short of the 180-square-foot minimum, landlords commonly assess whether a qualifying closet—one with at least a six-foot ceiling height and a connecting doorway—exists, and document its floor area (up to 20 square feet) to determine whether the combined total meets the threshold. Maintaining accurate floor-area records for each unit helps demonstrate compliance with this provision.

Section 15-64 gives occupants a baseline protection: a dwelling unit housing more than one person must meet the 180-square-foot habitable floor area standard set by Bellevue's Code of Ordinances. If a tenant believes their unit falls below this threshold and is being occupied by multiple people, that potential violation may be relevant to housing complaints filed with local code enforcement authorities. Tenant-rights organizations familiar with Nebraska housing codes can help individuals understand what options may be available when a unit appears to fall short of the requirements under § 15-64.
