Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-60
SPACE, USE AND LOCATION—GENERALLY
Operative Text
No person shall occupy or let to another for occupancy any dwelling or dwelling unit, for the purpose of living therein, which does not comply with the requirements provided in this article. (1964 Code, § 12A-19)
Under Bellevue, Neb., Code of Ordinances ch. 15, art. III § 15-60, no dwelling or dwelling unit may be occupied or rented for residential living unless it meets the space, use, and location requirements set out in Article III. The rule applies equally to the act of moving in and the act of renting out—both are prohibited if the unit falls short of those standards. This provision establishes a baseline habitability floor tied to the physical and locational characteristics of the housing itself.
Plain English — not legal advice.
Bellevue, Neb., Code of Ordinances ch. 15, art. III § 15-60 means that compliant property operators generally verify that every dwelling unit satisfies all Article III space, use, and location standards before offering it for rent or allowing occupancy. Keeping records of inspections and any corrective work done to bring a unit into compliance is a common practice among operators who manage to this standard. Renting or allowing a tenant to move into a unit that does not meet these requirements is itself a violation of § 15-60, independent of any tenant complaint.

Bellevue, Neb., Code of Ordinances ch. 15, art. III § 15-60 establishes that a dwelling unit must meet Article III's space, use, and location requirements as a condition of lawful occupancy—meaning tenants have a basis to raise noncompliance as an issue if those standards are not met. General enforcement paths can include filing a complaint with the local code-enforcement or housing authority, raising the violation as a defense in relevant legal proceedings, or consulting a tenant-rights organization familiar with Bellevue municipal code. Documenting the conditions in the unit and any communications with the landlord is a step commonly taken by tenants who believe § 15-60 standards are not being met.
