Plain English

Under Bellevue, Neb., Code of Ordinances ch. 15, art. II § 15-33, when the Permits and Inspections Department officially placards a dwelling or dwelling unit as unfit for human habitation, that property must be vacated within a timeframe set by the division. Once that deadline passes, neither renting nor occupying the placarded unit is permitted. The rule applies to owners, operators, and occupants alike, creating a blanket prohibition on human habitation of condemned units after the required vacation date.

For Property Managers

Under § 15-33, a property owner or operator who receives a placard from Bellevue's Permits and Inspections Department declaring a unit unfit for human habitation is generally expected to ensure the unit is vacated by the deadline the division establishes. Compliant operators do not re-rent or allow continued occupancy of a placarded unit after that date. Keeping records of the placard notice, the required vacation date, and any remediation steps taken is a practice commonly associated with responsible property management under this type of provision.

For Tenants

Section 15-33 of Bellevue's Code of Ordinances means that if your dwelling has been officially placarded as unfit for human habitation by the Permits and Inspections Department, you have a right to know the deadline by which the division requires the unit to be vacated. Continued occupancy after that date is prohibited under the ordinance, and a landlord cannot lawfully re-rent a placarded unit to anyone. Tenants facing a placard situation may wish to contact Bellevue's Permits and Inspections Department for information about the required timeline, or reach out to a local tenant-rights organization to understand available options.
