Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-24
Any person affected by any notice which has been issued in connection with the enforcement of any provision of this chapter, or of any rule or regulation adopted pursuant thereto, may request and shall be granted a hearing on the matter before the Permits and Inspections Department; provided, that such person shall file in the office of the Permits and Inspections Department a written petition requesting such hearing and setting forth a statement of the grounds therefor within ten days after the day the notice was served. Within ten days of receipt of such petition the Permits and Inspections Department shall set a time and place for such hearing and shall give the petitioner written notice thereof. At such hearing the petitioner shall be given an opportunity to be heard and to show cause why such notice should be modified or withdrawn. The hearing before the Permits and Inspections Department shall be commenced not later than 30 days after the date on which the petition was filed; provided, that upon written application of the petitioner to the Permits and Inspections Department, he may postpone the date of the hearing for a reasonable time beyond such 30-day period, if in his judgment the petitioner has submitted a good and sufficient reason for such postponement. Any notice served pursuant to the preceding section will automatically become an order if a written petition for a hearing is not filed in the office of the Permits and Inspections Department within ten days after such notice is served. Any permit which has been suspended by a notice shall be deemed to be automatically revoked if a petition for hearing is not filed in the office of the Permits and Inspections Department within ten days after such notice is served. The Permits and Inspections Department shall have the power to administer oaths and affirmations in connection with the conducting of any hearing held in accordance with the provisions of this chapter.

Plain English

Under Bellevue, Neb., Code of Ordinances ch. 15, art. II § 15-24, any person who receives an enforcement notice related to housing code requirements has the right to contest that notice by requesting a formal hearing before the Permits and Inspections Department. To trigger this right, a written petition must be filed within ten days of the notice being served, stating the grounds for the challenge. If no petition is filed within that ten-day window, the notice automatically becomes a binding order, and any suspended permit is automatically revoked.

For Property Managers

Property owners and managers who receive an enforcement notice under Bellevue, Neb., Code of Ordinances ch. 15, art. II § 15-24 generally track the ten-day filing deadline carefully, since missing it converts the notice into a final order and can result in automatic permit revocation. Compliant operators typically prepare a written petition that clearly states the grounds for contesting the notice and deliver it to the Permits and Inspections Department within that window. Once a petition is filed, operators generally remain available to participate in the scheduled hearing, which must begin no later than 30 days after the petition is filed unless a postponement is granted.

For Tenants

Tenants and other affected parties have a right under Bellevue, Neb., Code of Ordinances ch. 15, art. II § 15-24 to request a hearing before the Permits and Inspections Department if they receive or are affected by an enforcement notice. The ten-day deadline for filing a written petition is critical — missing it means the notice becomes an automatic order with no further opportunity to contest it through this process. Those seeking to understand their options may benefit from consulting a local tenant-rights organization or legal aid provider familiar with Bellevue's housing code procedures.
