Plain English

Under Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-176, operating permits for rooming houses, second class dwellings, hotels, and nursing homes cannot be passed along to a new owner or operator. When control of such a property changes hands, the outgoing operator must notify the Permits and Inspections Department in writing within 24 hours and provide the name and address of the incoming operator. The rule ensures that local authorities always have current information about who is responsible for operating these types of residential and lodging facilities.

For Property Managers

Operators covered by Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-176 generally ensure that any sale, gift, or other transfer of a rooming house, second class dwelling, hotel, or nursing home is promptly reported to the Permits and Inspections Department in writing within 24 hours of relinquishing control. A compliant operator also submits the full name and address of the incoming operator at that time. Because the permit itself cannot be transferred, the new operator would need to pursue their own permit through the appropriate channels.

For Tenants

Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-176 establishes that when ownership or control of a rooming house, second class dwelling, hotel, or nursing home changes, the outgoing operator is required to report that change to the Permits and Inspections Department within 24 hours. Tenants in these facilities may find it useful to know that a new operator is not automatically authorized to operate under the previous owner's permit. Those with concerns about whether a facility is properly permitted after a change in ownership can contact the Bellevue Permits and Inspections Department directly or reach out to a local tenant-rights organization for general guidance.
