Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-156
The operator of a rooming house, second class dwelling, hotel or nursing home shall be responsible for the extermination of any insects, rodents or pests therein; and he shall be further responsible for such extermination on the entire premises where the entire structure or building within which the rooming house, second class dwelling, hotel or nursing home is contained or is leased or occupied by the operator. Notwithstanding the foregoing provisions of this section, when overinfestation of any premises is caused by failure of the owner to maintain the dwelling within which the rooming house, second class dwelling, hotel or nursing home is contained in a ratproof or reasonably inspectproof condition, extermination shall be the responsibility of the owner.

Plain English

Under Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-156, operators of rooming houses, second-class dwellings, hotels, and nursing homes bear primary responsibility for exterminating insects, rodents, and other pests on the entire premises they lease or occupy. However, when an infestation results from the building owner's failure to keep the structure ratproof or reasonably inspectproof, the responsibility for extermination shifts to the owner rather than the operator. This provision draws a clear line between operator-caused pest problems and those that stem from the physical condition of the building itself.

For Property Managers

Operators and owners of rooming houses, second-class dwellings, hotels, and nursing homes in Bellevue should be aware that § 15-156 assigns extermination duties based on the source of the infestation. Compliant operators generally maintain ongoing pest-control programs covering all leased or occupied premises, while building owners typically keep structures in a ratproof and reasonably inspectproof condition to avoid having extermination responsibility shift to them under Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-156. Documenting the physical condition of the building and any pest-control measures taken can help clarify which party bears responsibility if a dispute arises.

For Tenants

Residents of rooming houses, second-class dwellings, hotels, or nursing homes in Bellevue may find it useful to know that Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-156 places pest extermination duties on the operator—or on the building owner when structural deficiencies like inadequate ratproofing are the root cause. Tenants who observe pest infestations may consider documenting conditions with photographs and written notices to the operator or owner, and can explore filing a complaint with local code enforcement if the responsible party fails to act. Tenant-rights organizations can help residents understand which enforcement paths may be available under this provision.
