Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-143
SAME—LOCATION OF SANITARY FACILITIES
Operative Text
Every toilet, lavatory basin and bath shall be located within a room or rooms which afford privacy to a person within such room or rooms. All such facilities shall be so located within the rooming house, second class dwelling, hotel or nursing home as to be accessible to the occupants of each rooming unit sharing such facilities without going outside of the dwelling, hotel or nursing home and without going through a rooming unit, a dwelling unit, hotel unit or nursing home unit of another occupant. (Code 1964, § 12A-32)
Under Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-143, every toilet, lavatory, and bath in a rooming house, second-class dwelling, hotel, or nursing home must be placed in a room that provides privacy to anyone using it. Additionally, shared sanitary facilities must be reachable by all occupants who share them without requiring anyone to step outside the building or pass through another occupant's private unit. This rule ensures that access to basic hygiene facilities is both private and internally accessible within the structure.

Operators of rooming houses, second-class dwellings, hotels, and nursing homes in Bellevue should ensure that all toilet, lavatory, and bath facilities comply with Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-143 by situating them in enclosed, private rooms. Compliant properties are designed so that any shared facilities can be reached through common interior hallways or corridors, never requiring a tenant to exit the building or walk through another occupant's private unit. Reviewing floor plans and access routes against this standard is a common practice during property inspections and renovations.

Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-143 gives occupants of rooming houses, second-class dwellings, hotels, and nursing homes the right to access shared toilet, lavatory, and bath facilities privately and without passing through another resident's unit or going outdoors. If shared sanitary facilities are not accessible in this manner, that may constitute a code violation that tenants can report to the appropriate local code enforcement or housing authority. Tenants may also wish to consult a tenant-rights organization to understand the range of options available when such conditions are not met.
