Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-140
APPLICABILITY OF OTHER PROVISIONS OF THIS CHAPTER
Operative Text
No person shall operate a rooming house, second class dwelling, hotel or nursing home unless all of the requirements of sections 15-50--15-70 and 15-97--15-111 are complied with; provided, that for the purpose of interpreting the requirements of the designated sections applicable in the enforcement of this subsection, the words “multiple dwelling” or “dwelling” shall be interpreted to mean “rooming house,” “second class dwelling,” “hotel” or “nursing home” and the words “dwelling unit” or “dwelling units” shall be interpreted to mean “rooming unit,” “second class dwelling,” “hotel” or “nursing home unit or units.” Every dwelling unit located with a rooming house, second class dwelling, hotel or nursing home shall comply with all of the requirements for dwelling units as established in accordance with the provisions of this chapter. (Code 1964, § 12A-31)
Section 15-140 of Bellevue, Nebraska's Code of Ordinances extends the housing standards already established for multiple dwellings and dwelling units to rooming houses, second-class dwellings, hotels, and nursing homes. It does this by directing that whenever those earlier code sections (15-50 through 15-70 and 15-97 through 15-111) use terms like 'multiple dwelling' or 'dwelling unit,' those terms are read to include the covered facility types. Any individual dwelling unit located within one of these facilities must also meet all dwelling-unit requirements set out elsewhere in Chapter 15.

Operators of rooming houses, second-class dwellings, hotels, or nursing homes in Bellevue are generally expected to meet the same structural, maintenance, and habitability standards found in sections 15-50 through 15-70 and 15-97 through 15-111, which were originally written for conventional dwellings. Under § 15-140, compliance means applying those standards as if the facility were a multiple dwelling and each rentable space were a dwelling unit. Operators who also rent out self-contained dwelling units within these facilities must ensure those units independently satisfy all Chapter 15 dwelling-unit requirements.

Residents of rooming houses, second-class dwellings, hotels used as long-term housing, or nursing homes in Bellevue have the benefit of § 15-140, which brings their accommodations under the same baseline housing standards that apply to conventional rental dwellings. If conditions in a facility appear to fall short of the requirements referenced in sections 15-50 through 15-70 and 15-97 through 15-111, tenants may consider documenting the conditions and contacting the local code enforcement or housing authority to report a potential violation. Tenant-rights organizations can help residents understand which specific standards apply to their type of accommodation and what complaint or defense options may be available.
