Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-139
The issuance of any permit and occupancy record card to any rooming house, second class dwelling, hotel or nursing home shall not in any way signify or imply that the rooming house, second class dwelling, hotel or nursing home conforms with the state building code or the building and zoning ordinances of the city. It shall be the duty of the chief building official to enforce the provisions of such building and zoning codes and ordinances. The issuance of a rooming house, second class dwelling, hotel or nursing home permit shall not relieve the owner or operator thereof of the responsibility of compliance with such building and zoning codes and ordinances and shall not relieve the chief building official of the responsibility for enforcement of such building and zoning codes and ordinances.

Plain English

Under Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-139, receiving a permit or occupancy record card for a rooming house, second-class dwelling, hotel, or nursing home does not mean the property has been found to comply with Nebraska's state building code or the city's building and zoning ordinances. The permit and those separate code requirements operate independently of each other. The chief building official retains the ongoing duty to enforce building and zoning rules regardless of what permits have been issued.

For Property Managers

Under § 15-139, operators and owners of rooming houses, second-class dwellings, hotels, and nursing homes in Bellevue should understand that holding a valid permit does not substitute for full compliance with state building codes and city zoning ordinances. Compliant operators typically treat permit issuance and code compliance as two distinct, parallel obligations—maintaining the property to applicable building and zoning standards at all times. The chief building official may inspect and enforce those standards independently of the permit status.

For Tenants

Section 15-139 makes clear that a landlord's possession of a rooming house or second-class dwelling permit in Bellevue does not guarantee the property meets state building codes or city zoning ordinances. Tenants who observe potential building or zoning violations may direct concerns to the city's chief building official, who is expressly charged with enforcement under this provision. Tenant-rights organizations can also help residents understand what standards apply to their housing type and what general options exist for raising concerns.
