Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-138
OPERATOR TO CONTROL OCCUPANCY
Operative Text
No operator shall at any time allow a large number of persons to occupy the total of all rooming units, second class dwelling units, hotel units or nursing home units located within a rooming house, second class dwelling, hotel or nursing home than the maximum number of persons listed on the permit and the occupancy record card. No operator shall at any time allow a larger number of persons to occupy any individual rooming unit, second class dwelling unit, hotel unit or nursing home unit than the maximum number of persons listed on the occupancy record card for each such rooming unit, second class dwelling unit, hotel unit or nursing home unit. No operator shall at any time permit any person to occupy any rooming unit, second class dwelling unit, hotel unit or nursing home unit which is not listed on the occupancy record card. (Code 1964, § 12A-29)
Under Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-138, operators of rooming houses, second class dwellings, hotels, and nursing homes are prohibited from allowing occupancy that exceeds the limits recorded on the facility's permit and occupancy record card—both for the building as a whole and for each individual unit. Additionally, no unit that is absent from the occupancy record card may be occupied at all. This rule ties lawful occupancy directly to the documented records maintained for each property and unit.

Operators subject to Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-138 generally keep their permit and occupancy record cards current and accurate, ensuring that the number of occupants in each unit—and across the entire facility—never exceeds the maximums listed on those documents. Compliant operators also refrain from allowing any unit to be occupied if it does not appear on the occupancy record card. Maintaining up-to-date records and conducting periodic occupancy checks are practices commonly associated with meeting this provision's requirements.

Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-138 establishes that each unit you occupy must be listed on the operator's occupancy record card and that the number of residents must not exceed the card's stated maximum. If you believe your unit is unlisted or that the operator is violating occupancy limits, you may consider contacting the relevant Bellevue municipal authority responsible for housing code enforcement to inquire about the property's permit and record card status.
