Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-116
SAME—GARBAGE DISPOSAL OR STORAGE FACILITIES
Operative Text
Every occupant of a dwelling containing one dwelling unit and every occupant of a dwelling containing two dwelling units, except as provided in section 15-49, shall furnish adequate garbage disposal facilities or garbage storage containers whose type and location are approved. (Code 1964, § 12A-8)
Under Bellevue, Neb., Code of Ordinances ch. 15, art. IV § 15-116, occupants of single-unit and two-unit dwellings are responsible for providing adequate garbage disposal facilities or storage containers, subject to approval of both the type and placement of those containers. An exception exists for situations addressed in section 15-49. This rule places the compliance burden on the occupant rather than the property owner in these smaller dwelling configurations.
Plain English — not legal advice.
Property owners and managers operating single-family or two-unit rental properties in Bellevue should be aware that Bellevue, Neb., Code of Ordinances ch. 15, art. IV § 15-116 places the primary responsibility for approved garbage disposal or storage facilities on the occupant, not the landlord, except where section 15-49 applies. Compliant operators typically confirm that lease agreements clearly address garbage responsibilities and that any containers on the property meet local approval standards for type and location. Keeping documentation of approved container types and their placement can support ongoing compliance.

Under Bellevue, Neb., Code of Ordinances ch. 15, art. IV § 15-116, occupants of one- and two-unit dwellings generally bear the responsibility for furnishing garbage disposal or storage containers that are approved for both type and location, unless section 15-49 provides otherwise in a given situation. Tenants who have questions about whether their current setup meets local approval standards may wish to review their lease terms and consult with local code enforcement or a tenant-rights organization familiar with Bellevue ordinances.
