Limitations
Operative Text
(a) Nothing in this article shall be deemed to prohibit owners from giving preference to prospective buyers or tenants for any reason other than race, marital status, color, sex, religion, national origin, physical or mental handicap, familial status, height, weight and age. (b) Nothing in this article shall be construed as to limit the right of access by an individual to remedies before the state civil rights commission or before the courts of this state on an individual basis or to prohibit the cooperation between the City and the state civil rights commission. (c) Nothing in this article shall require an owner to offer property to the public at large before selling or renting it.
St. Clair Shores — Ch. 22 Art. II Fair Housing § 22-24 sets out what the city's fair housing article does not restrict. Owners retain the freedom to prefer certain buyers or tenants for any reason that is not one of the protected characteristics listed in the article, such as race, sex, religion, or disability. The provision also preserves individuals' rights to pursue remedies through the Michigan Civil Rights Commission or state courts, and it does not obligate owners to market property to the general public before selling or renting.

Under St. Clair Shores — Ch. 22 Art. II Fair Housing § 22-24, compliant property owners understand that while they may not discriminate on the basis of protected characteristics, they are not required to advertise or offer their property to the public at large before entering into a sale or rental agreement. Owners who apply preferences based on factors unrelated to the article's protected classes — such as a personal referral or a prior relationship — generally remain within the scope of what this provision allows. Keeping clear records of the non-protected reasons behind any preference can help demonstrate compliance with the article's requirements.

St. Clair Shores — Ch. 22 Art. II Fair Housing § 22-24 explicitly preserves tenants' and prospective buyers' rights to seek remedies outside the city's own process — including filing a complaint with the Michigan Civil Rights Commission or pursuing a claim in state court. If a person believes they were denied housing based on a protected characteristic such as race, familial status, or disability, this provision makes clear that the city's article does not block access to those independent enforcement paths. Tenant-rights organizations can help individuals understand which avenue may be appropriate for their circumstances.
