Southfield — Ch. 103 Registration Requirements for Rental or Leased Dwellings § 8.514
Violation and penalty
Operative Text
(a) A violation of any provision of this chapter shall constitute a municipal civil infraction, and shall be subject to the relief provided for municipal civil infractions under chapter 15 of the Code. (b) In addition, any use or activity in violation of the terms of this chapter is hereby declared to be a nuisance per se and may be abated by order of any court of competent jurisdiction. The city, in addition to other remedies, may cause to be instituted any appropriate action or proceeding to vacate the premises and/or prevent, abate or restrain the nuisance violation.
Under Southfield Ch. 103 § 8.514, any failure to comply with the rental registration requirements set out in Chapter 103 is treated as a municipal civil infraction, subject to the remedies available under Chapter 15 of the Southfield Code. Beyond civil infraction penalties, any non-compliant use or activity is automatically classified as a nuisance per se, meaning no additional proof of harm is required to establish it as a nuisance. Courts of competent jurisdiction may order abatement, and the City of Southfield may pursue legal action to vacate premises or restrain the offending activity.
Plain English — not legal advice.
Property owners and managers subject to Southfield Ch. 103 § 8.514 generally maintain compliance by ensuring all required registrations under Chapter 103 are current and accurate before renting or leasing any dwelling unit. A compliant operator keeps documentation readily available and promptly addresses any deficiencies identified by the city, since violations can trigger both civil infraction proceedings under Chapter 15 and a nuisance-per-se designation. Because the city holds authority to seek court orders vacating premises or restraining non-compliant activity, operators typically treat registration obligations as a foundational step in property management.

Tenants living in a rental unit in Southfield may find § 8.514 of Ch. 103 relevant if their landlord has failed to comply with the city's registration requirements, since such a failure constitutes both a municipal civil infraction and a nuisance per se under city law. This provision gives the City of Southfield independent authority to pursue court action, which means enforcement is not solely dependent on a tenant's own complaint. Tenants who believe their housing may be affected by a registration violation can contact the City of Southfield directly or reach out to a local tenant-rights organization to understand what options may be available.
