Livonia — Ch. 5.42 Rental Dwellings (Hotels, Lodginghouses, Roominghouses) § 5.42.005
The city finds that there are rental dwellings in the city which have become deteriorated to the extent that they no longer provide safe, secure and sanitary living quarters. The city also finds that the elimination and prevention of the conditions such as those outlined in this chapter are necessary and in the best interest of the city and its citizens. The city recognizes a compelling interest in establishing standards for the maintenance and occupancy of sanitary and safe rental dwellings within the city. Such standards are an important factor supportive of the general health, safety and welfare of all of its citizens. This chapter is designed to promote the continuing maintenance of quality and safe rental dwellings, and to maintain and enhance property values. To accomplish these goals, it is the intention of the city to exercise its full powers to protect the public health, safety and welfare, whether the powers exercised are derived from the constitution, state law or the city Charter.

Plain English

Livonia Ch. 5.42 § 5.42.005 establishes the city's stated rationale for regulating rental dwellings, including hotels, lodginghouses, and roominghouses. The city has determined that some rental properties have deteriorated to the point of being unsafe or unsanitary, and that setting and enforcing maintenance and occupancy standards serves the broader public health, safety, and welfare. This provision does not itself impose specific duties but frames the policy foundation for all requirements that follow in Chapter 5.42.

For Property Managers

Livonia Ch. 5.42 § 5.42.005 signals that the city has committed to actively using its full legal authority — drawn from the state constitution, state law, and the city Charter — to enforce rental housing standards. Operators of rental dwellings, including hotels, lodginghouses, and roominghouses, generally maintain properties in a condition that is safe, secure, and sanitary in order to align with the chapter's overarching goals. Understanding this purpose section helps property managers anticipate the scope and intent behind the specific maintenance and occupancy requirements found throughout Chapter 5.42.

For Tenants

Livonia Ch. 5.42 § 5.42.005 reflects the city's formal recognition that safe and sanitary rental housing is a matter of public interest, providing the policy backbone for tenant protections established elsewhere in Chapter 5.42. Tenants living in hotels, lodginghouses, roominghouses, or other rental dwellings in Livonia can point to this purpose provision when raising concerns about deteriorated or unsafe conditions, as it underscores the city's stated commitment to enforcement. Those experiencing habitability issues may consider contacting the city directly, reaching out to a local tenant-rights organization, or reviewing the specific standards set out in the remainder of Chapter 5.42 to understand available options.
